surrogacy in Armenia

Surrogacy in Armenia is gaining momentum due to a possible ban on foreign couple surrogacy in Georgia.  For those who are familiar with the surrogacy dynamic, once a country closes its door to surrogacy, a nearby country emerges to give possible surrogacy country options. The same thing is happening with Armenia as most of the surrogacy clinics in Georgia and surrogacy agencies in Georgia are now moving to Armenia.

Surrogacy in Armenia is emerging as an option for international intended parents due to its relatively lower costs and accessibility. Overview of Surrogacy in Armenia

There are two main types of surrogacy allowed in Armenia:

  • Traditional surrogacy: The surrogate’s own egg is used and she is biologically related to the baby. This is very rare in Armenia currently.
  • Gestational surrogacy: The most common type, where the surrogate carries a pregnancy using an embryo created with donor eggs and sperm or embryos from the intended parents. The surrogate has no genetic relation to the baby.

Gestational surrogacy using IVF with donor eggs/sperm is by far the most common arrangement in Armenia.

Surrogacy Laws in Armenia

Armenia’s liberal surrogacy laws attract many international intended parents. Here are some key legal considerations:

  • Compensated surrogacy is legal. Surrogates can receive reasonable compensation beyond just medical expenses.
  • Traditional surrogacy was banned in 2021. Only gestational surrogacy is now allowed.
  • The intended parents are recognized as the legal parents directly after birth, once they do the DNA test to confirm the genetic link.
  • Surrogacy is allowed for heterosexual couples.
  • Non-residents and foreigners have access to Armenia’s surrogacy programs.

Is Surrogacy Legal in Armenia?

Armenia does not have a specific surrogacy law that regulates the practice. However, the country allows assisted reproductive technologies (ART), including IVF and egg donation. While surrogacy is not explicitly prohibited, the absence of legal protections can create challenges in establishing parental rights.

Legal Considerations for Intended Parents

  • Surrogacy contracts may not be legally enforceable, meaning intended parents must carefully navigate parental rights.
  • Armenia does not explicitly prohibit international surrogacy, but there are no clear legal pathways for foreign intended parents to obtain parental recognition.
  • Citizenship and birth certificate issues can arise. It is crucial to consult a legal expert to understand how parental rights are established post-birth.
  • Unlike Georgia or Ukraine, Armenia does not offer pre-birth orders for parental recognition, which may require additional legal steps in the intended parents’ home country.

Surrogacy Timeline: How much time it takes for surogacy journey

Step-by-Step Surrogacy Process in Armenia

  1. Initial Consultation – Intended parents meet with an agency or fertility clinic to discuss medical and legal aspects.
  2. Surrogate Selection – A healthy, medically screened surrogate is chosen.
  3. Legal Consultation – Legal experts draft agreements (though enforcement is uncertain).
  4. IVF & Embryo Transfer – The embryo is created via IVF and transferred to the surrogate.
  5. Pregnancy & Monitoring – The surrogate receives prenatal care, with regular updates to intended parents.
  6. Birth & Legal Process – Post-birth, intended parents apply for parental recognition and complete legal steps in their home country.

The complete surrogacy process in Armenia takes approximately 12-15 months from start to finish when successful. Here are the key stages:

  1. Consultations

Everything begins by consulting with a surrogacy agency and fertility clinic to learn about the process, costs, and legal issues. They will advise the intended parents on the next steps.

  1. Matching with a Surrogate

The agency will screen potential surrogates and facilitate match meetings for intended parents to connect and agree on moving forward together. Matching can take 2-3 months.

  1. Legal Contracting

Extensive legal contracts are signed between all involved parties, including the intended parents, surrogate, agency, and fertility clinic, stipulating all terms. Independent lawyers are utilized.

  1. IVF Process & Embryo Transfer

Using eggs/sperm from the intended parents or donors, embryos are created through IVF. 1-2 embryos are then transferred into the surrogate’s uterus in a quick, noninvasive procedure.

  1. Pregnancy Monitoring

The surrogate will need regular appointments at the fertility clinic including ultrasounds, lab tests, and checkups to monitor the health of the pregnancy as it progresses.

  1. Delivery of the Baby

Doctors typically deliver the baby via planned C-section between weeks 32-36. The surrogate will stay at the hospital to recover for 2-3 days after birth.

  1. Post-Birth Legalities

The intended parents will be listed on the birth certificate. Passport, visa, and citizenship documents are obtained for the baby’s trip home.

  1. Return Home with Baby

The intended parents will need to stay in Armenia for roughly 2 weeks after birth to complete the legal paperwork and obtain clearance to travel home with their newborn.

The entire successful surrogacy process in Armenia will take about 12-15 months from initial consultations through bringing home the newborn baby. Maintaining excellent communication between all parties is crucial throughout each step.

What are the success rates?

Our IVF clinics have surrogacy success rates of about 80 %. We examine all embryos (IVF with PGD/NGS) and only a healthy embryo will be transferred to the uterus of a Surrogate mother.

What happens if we have a failed attempt?

If there are additional frozen embryos for transfer, a new transfer could be conducted within 1 month. If there are no more embryos, an additional cycle will need to be conducted to cultivate more embryos.

What prenatal monitoring is conducted during the pregnancy?

A beta HCG test is conducted approximately 2 weeks after embryo implantation. If the test is positive, a second test is conducted 48-72 hours later to track hormone levels. From there, a confirmatory ultrasound is conducted at approximately week 7 of gestation. The latest non-invasive prenatal testing is then conducted at week 10 to check for chromosomal issues with the fetus and can also tell the gender of your baby very early in the pregnancy. Ultrasounds will then be conducted monthly throughout the pregnancy.
